A first offense of driving under the influence, or DUI, of alcohol or drugs is the most common DUI case in Alameda County. First offense DUI cases can be heard in the Oakland, Fremont and Dublin courthouses and are generally misdemeanor offenses. First offense DUI cases can be charged as felonies if the individuals was involved in an injury causing collision or if separate felony, i.e. child endangerment, is also charged. A first offense DUI in Alameda County can take anywhere from sixty days to six months to resolve not including jury trial. First Offense DUI cases usually resolve for a punishment of three to five years. of informal probation, a $2,000 court fine, a three to nine month long DUI school, up to six months in the county jail usually served on the Sheriff’s Work Alternative Program or SWAP and a six month to one year California Driver’s License suspension. A restricted driver’s license might be possible with an SR22 insurance policy and potential installation of an ignition interlock device or IID. Depending on the specific case, the jail sentence may be either in custody or through a jail alternative program like the Sheriff’s Work Alternative Program or SWAP. Second Offense DUI’s are generally misdemeanors but can elevated to felony offenses if the DUI involved an injury causing collision or if the prior DUI conviction was a felony. A second offense DUI carries with it a two year license suspension with the possibility of a restricted license with an SR22 insurance policy, however, DUI sentencing enhancements can prohibit a restricted license. Description: Client was observed driving on State Route 4 by the California Highway Patrol and was clocked at 104 miles per hour. Client was stopped for speeding and performed field sobriety tests and submitted to a preliminary breath test with a .14% blood alcohol concentration. Client arrested for driving under the influence or DUI of alcohol and submitted to two additional breath tests of .14% BAC. The Contra Costa County District Attorney took eight months to file charges but today we smartly settled this DUI case at arraignment today before the case was sent to a pretrial conference since prehearing research showed that client was not initially charged with the speed enhancement which would have resulted in a sixty day jail sentence. This strategy got the minimum punishment for client without an enhancement.
